Terms of Service
Clinch Mountain Bodywork (C.M.S) · Effective date: August 14, 2026
These Terms of Service (“Terms”) govern your use of the Clinch Mountain Bodywork app (the
“App”), operated by the massage practice of Josh Robinson, sole proprietor
(“the Practice”, “we”, “us”). By creating an account or using the App, you agree to these Terms and to our
Privacy Policy. If you do not agree, please do not use the App.
1. What the App is
The App lets clients of the Practice request and manage massage appointments and exchange
messages with the Practice. The App is a scheduling and communication tool; the massage services
themselves are provided in person by the Practice under its own professional obligations.
2. Your account
- You sign in with your mobile phone number using a one-time code. Keep your phone secure —
anyone with access to your phone number and device may be able to access your account.
- You agree to provide accurate information (your real name and a phone number you own) and to
keep it up to date.
- You must be at least 18 years old, or use the App with the involvement of a parent or legal
guardian, to create an account.
- One account per person. You may not use another person’s account or let others use
yours.
3. Appointments
- Requests: a booking you make in the App is a request until the
Practice confirms it. The App shows the status of each request.
- Cancellations: you may cancel a confirmed appointment in the App up to the
cancellation window shown at booking. Inside that window, contact the Practice directly
through Messages — late cancellations and no-shows may be subject to the Practice’s
cancellation policy.
- Changes by the Practice: the Practice may confirm, decline, reschedule, or
cancel appointments (for example due to illness or scheduling conflicts). You will be notified
through the App or your chosen notification channel.
- Payment: the App does not process payments. Payment for services is handled
directly with the Practice.
4. Messaging
- Messages in the App go to the Practice and are answered when the Practice is available —
messaging is not monitored continuously and is not for urgent matters.
- Do not use the App for emergencies. If you have a medical emergency, call
your local emergency number.
- The App does not provide medical advice. Information shared through the App is for
scheduling and care coordination with the Practice only.
5. Acceptable use
You agree not to:
- use the App to harass, threaten, or abuse anyone, or send unlawful or offensive content;
- make appointment requests you do not intend to keep, or otherwise interfere with the
Practice’s schedule;
- attempt to access other users’ information, probe or disrupt the service, or reverse
engineer the App except where the law permits.
6. Mobile messaging (SMS) terms
Program. C.M.S account notifications, sent by the Practice. Your phone number
is used to send a one-time verification code when you sign in. You consent to ongoing text
notifications only by ticking the separate SMS-consent checkbox on the sign-in screen (unchecked
by default) or by choosing “Text message (SMS)” in the App’s notification
settings. Consent is not a condition of purchasing any service.
- Message types: one-time sign-in codes, appointment confirmations and
reminders, and alerts when the Practice sends you a message. Transactional only — no
marketing or promotional messages.
- Message frequency varies with your bookings (typically 2–3 messages
per appointment).
- Message and data rates may apply. Check with your carrier for details of
your plan.
- Opt out: reply STOP to any message to cancel text
messages, or switch your notification preference to push notifications in the App’s
settings. After you opt out you may receive one final message confirming your opt-out. A
sign-in code may still be sent when needed to access your account.
- Help: reply HELP to any message, or contact us at the
address in section 13.
- Carriers are not liable for delayed or undelivered messages.
- Your number: We do not share, sell, or provide your mobile phone number or
messaging consent data to third parties or affiliates for marketing or promotional purposes.
No mobile information will be shared with third parties/affiliates for marketing/promotional
purposes. See the Privacy Policy for full details of how your
information is handled.
Push notifications are delivered through your device’s notification system and can be
managed in your device settings.
7. Intellectual property
The App, including its design and content (other than the content of your own messages), belongs
to the Practice or its licensors. You get a personal, non-transferable license to use the App to
book and manage your appointments; no other rights are granted.
8. Ending your use
You can stop using the App at any time and delete your account in the App’s settings. We
may suspend or close accounts that violate these Terms, abuse the service or the Practice’s
staff, or repeatedly no-show, and we may discontinue the App itself with reasonable notice.
Deleting your account does not cancel obligations that arose before deletion (such as fees for a
missed appointment under the Practice’s policy).
9. Disclaimers
The App is provided “as is” and “as available.” We work
to keep it reliable, but we do not guarantee that it will be uninterrupted, error-free, or that
every notification will be delivered (delivery depends on your device, carrier, and email
provider). To the fullest extent permitted by law, we disclaim all warranties, express or
implied, about the App. Nothing in these Terms affects the professional standards that apply to
the massage services themselves.
10. Limitation of liability
To the fullest extent permitted by law, the Practice will not be liable for indirect,
incidental, special, or consequential damages arising from your use of the App (for example a
missed appointment due to an undelivered reminder). Our total liability for claims relating to
the App will not exceed one hundred US dollars (US $100). Some jurisdictions do not allow
certain limitations, so parts of this section may not apply to you.
11. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the
effective date above and notify you through the App. Continued use of the App after a change
means you accept the updated Terms.
12. Governing law
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its
conflict of law rules. Disputes will be resolved in the state or federal courts located in
Virginia, unless applicable law gives you the right to another forum.
